1Acceptance of Terms

By accessing and using Smart Trails ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these Terms of Service, you are not authorized to use or access the Service.

2Description of Service

Smart Trails is an AI-powered web application that generates personalized trekking and hiking itineraries. The Service uses artificial intelligence technology to create detailed, location-specific outdoor adventure plans based on user preferences and requirements.

3User Accounts and Registration

3.1 Account Creation

To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify Smart Trails of any unauthorized use of your account.

4Subscription and Payment Terms

4.1 Subscription Tiers

• Free Tier: Limited to 5 itinerary generations per month, maximum 3 saved itineraries
• Premium Tier: Unlimited itinerary generation and storage, advanced features, early access to new functionality

4.2 Payment Processing

Payment processing is handled by Stripe, a third-party payment processor. By providing payment information, you agree to Stripe's terms of service and privacy policy.

4.3 Billing and Cancellation

Subscriptions automatically renew until cancelled. You may cancel your subscription at any time through your account dashboard. Cancellations take effect at the end of the current billing period.

5Content Disclaimer and Limitation of Liability

5.1 Nature of AI-Generated Content

All trekking itineraries, route suggestions, accommodation recommendations, and related content provided through the Service are generated by artificial intelligence technology and are intended solely for informational and planning purposes. Such content does not constitute professional advice, guidance, or recommendations from qualified outdoor recreation professionals, travel agents, or local experts.

5.2 User Responsibility and Assumption of Risk

You expressly acknowledge and agree that:

1. You are solely responsible for independently verifying all aspects of any proposed itinerary, including but not limited to route safety, weather conditions, required permits, local regulations, accommodation availability, and current trail conditions;
2. Outdoor recreational activities, including hiking, trekking, and mountaineering, carry inherent and significant risks of injury, property damage, or death;
3. You voluntarily assume all risks associated with your use of any information provided by the Service;
4. You must exercise your own judgment, skill, and expertise in evaluating the suitability and safety of any suggested activities; and
5. You are responsible for ensuring you possess adequate experience, physical fitness, equipment, and insurance coverage for any activities you choose to undertake.

5.3 Third-Party Services Disclaimer

The Service may include references to or suggestions for third-party accommodations, transportation providers, guide services, equipment suppliers, or other vendors. Smart Trails does not endorse, guarantee, warrant, or assume any responsibility for the quality, safety, reliability, or availability of any third-party services.

5.4 Limitation of Liability

6User Conduct and Prohibited Uses

You agree not to use the Service to:

• Generate content for illegal activities or purposes
• Circumvent usage limitations or access controls
• Attempt to reverse engineer or extract proprietary algorithms
• Violate any applicable local, state, national, or international law
• Infringe upon intellectual property rights of others
• Harass, abuse, or harm another person or group
• Use the Service for any commercial purpose without our express written consent

7Intellectual Property Rights

7.1 Service Content

The Service, including its original content, features, and functionality, is owned by Smart Trails and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 User-Generated Content

You retain ownership of any content you input into the Service. By using the Service, you grant Smart Trails a limited license to process your inputs to generate itineraries and improve the Service.

8Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices regarding the collection and use of your personal information.

9Indemnification

You agree to indemnify, defend, and hold harmless Smart Trails, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your participation in any outdoor activities, or your breach of these Terms.

10Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.

11Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.

12Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the United States.
